Conduct: From 19 December 2017 Lisa Jayne Lee (“Ms Lee”) caused Temp Connexions Ltd (“Temp”) to trade to the detriment of His Majesty’s Revenue and Customs (“HMRC”) in respect of Construction Industry Scheme (“CIS”) payments. Temp entered liquidation on 07 September 2022, when HMRC were owed £264,004.09 in respect of CIS. On 19 December 2017 Temp’s debt for CIS owed to HMRC was £5,610.69. Temp submitted returns for CIS from November 2017 due 19 December 2017 to 22 August 2022 disclosing CIS liability of £273,265 and £282.92 in interest charges. No payments were made towards these liabilities. Between 23 March 2019 and 1 April 2019 payments totalling £5,252.41 were made and were attributed to the debt owed prior to December 2017. CIS liabilities totalled £264,004.09 when Temp entered liquidation. From 01 January 2018 to entering liquidation, Temp was liable for £273,265.92 of CIS and £282.92 for interest on overdue CIS. Comparative treatment: Bank statements show that from 19 December 2017 Temp received credits totalling £3,486,103.04 into its bank account. Of this, £15,155.04 was paid to HMRC in respect of CIS, £98,623.99 was paid to HMRC in respect of other taxes. In comparison, the director received £150,861.11, connected parties received £263,309, £1,965,366.65 was paid in salary and wages, £588,710.32 was paid on business expenditure.
