Conduct: On 26 October 2020, Mr Christoforos Panagopoulos (“Mr Panagopoulos”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Zante MK Building Construction Limited (“Zante”) to overstate its turnover on the BBL application, resulting in Zante receiving more monies than it was entitled to. In addition, Mr Panagopoulos failed to ensure that the entirety of the BBL was used for the economic benefit of Zante, in that: The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes, Zante was incorporated on 15 April 2016. On 26 October 2020 Mr Panagopoulos declared on the company’s BBL application form an annual turnover for 2019 of £250,000, Bank statements for the period 01 January 2019 to 31 December 2019 show total receipts of £12,936.74 attributable to business income. The overstatement of turnover totalling £237,063.26 meant that Zante received £46,765 more than it was entitled to from the BBL scheme. On 01 November 2020 Zante received a £50,000 BBL Prior to the receipt of BBL, the bank balance was £596.64 Between 04 November 2020 and 16 December 2020, Mr Panagopoulos caused Zante to make payments of £17,645 to third parties and payments of £30,700 to himself. During the same period, Zante received no trading income, Mr Panagopoulos failed to provide evidence to show that these payments were made for the economic benefit of Zante Zante entered Creditor’s Voluntary Liquidation on 26 October 2022. At liquidation, Zante had liabilities totalling £50,000, of which £46,879.56 was owed in respect of the BBL.
