Conduct: On 01 December 2020, Mr Marcus Church (“Mr Church”) breached the terms of the government backed Bounce Back Loan (“BBL”) Scheme by causing, or allowing, THE PROPERTY REVIVERS SUFFOLK LTD (“PRS”) to overstate its turnover on its application for a BBL, resulting in PRS receiving a BBL of £50,000 when he knew, or ought to have known, that PRS was not eligible for a loan of that value, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 1 January 2019, it is their estimated turnover from the date the company started to trade. • PRS was incorporated on 07 March 2016 and was trading before 01 January 2019 so was therefore required to provide actual turnover for the calendar year 2019 on the BBL application. • PRS’s bank statements show PRS had credits totalling £28,179 during 2019 after deducting credits from connected companies. • A profit and loss report from PRS’s accounting records shows turnover for 2019 totalling £17,394.71. • On 01 December 2020, Mr Church allowed PRS to declare on PRS’s BBL application form an annual turnover of £219,000, and consequently on 03 December 2020, PRS received a £50,000 BBL, the maximum amount available under the BBL scheme. • Based on a turnover for 2019 of not more than £28,179, PRS would have been only entitled to apply for a BBL of £7,045. • The overstatement of turnover meant that PRS received £42,955 more than it was entitled to from the BBL scheme. • PRS entered a creditors voluntary liquidation on 09 May 2025. • At liquidation, PRS had liabilities totalling £95,885, of which £28,811 (inclusive of interest) was owed to the Bank in respect of the BBL.
