Conduct: On 23 June 2020, Christinah Mokgatlhane (“Miss Mokgatlhane”) caused or allowed Fortune Major 1 Ltd (“Fortune”) to breach the terms of the Bounce Back Loan (“BBL”) scheme by overstating the Company’s turnover when applying for a BBL. As a result, Fortune received BBL funds of £50,000 when Miss Mokgatlhane knew, or ought to have known, that Fortune was not eligible for a BBL of that amount. In addition, Miss Mokgatlhane failed to ensure that the entirety of the BBL funds were used for the economic benefit of Fortune, contrary to the BBL terms, in that:    • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or, where a business was established after 1 January 2019, it was their estimated turnover.  The loan was to be used to provide economic benefit to the company, wholly for business purposes and not personal purposes. • Fortune was incorporated on 24 February 2016.  • Accounts for the financial years ending 28 February 2019 and 29 February 2020 confirm turnover as £34,539 and £38,571, respectively. • Bank statements for calendar year 2019 show turnover of £44,248. Therefore, the maximum BBL available to the Company was £11,062. • On 23 June 2020, Miss Mokgatlhane caused or allowed Fortune to apply for a BBL of £50,000, declaring that its turnover for the calendar year 2019 was £200,000.  • Fortune received the BBL funds of £50,000 on 24 June 2020, which was £38,938 more than Fortune was eligible for. • Between 25 June 2020 and 01 December 2020, bank statements record payments to Miss Mokgatlhane of £53,080, cash withdrawals of £750, and purchases for the benefit of Miss Mokgatlhane of £1,375, a total of £55,205. • Fortune’s bank balance prior to receipt of the BBL funds and sales during the period totalled £7,103. Therefore, at least £48,102 of the payments to or on behalf of Miss Mokgatlhane and the cash withdrawals derived from the BBL funds and were therefore not for the economic benefit of Fortune. • On 13 May 2025, Fortune entered Creditors Voluntary Liquidation with liabilities totalling £72,426, of which £47,325 was owed in respect of the BBL.
