Conduct: Garfield James Patterson (“Mr Patterson”) caused Patterg Consulting Ltd (“PCL”) to enter transactions totalling £31,728 between 19 May 2020 and 02 July 2020 which were to the detriment of PCL’s general body of creditors and when Mr Patterson knew or ought to have known that PCL was insolvent. In that: As of 18 May 2020, PCL owed £34,006 to HM Revenue & Customs (“HMRC”), mainly in respect of value Added Tax (“VAT”), which had been outstanding from at least the quarter ending May 2019 and which remained outstanding at liquidation Between 16 September 2019 and 20 April 2020, 3 creditors obtained judgement against PCL totalling £9,437 which remained unpaid on 18 May 2020 and subsequently at liquidation. By the 18 May 2020 PCL was insolvent with a deficiency of at least £46,841. Between 19 May 2020 and 02 July 2020 PCL transferred a total of £31,728 to a connected party under the reference ‘loan repayment’. PCL ceased to trade by 30 September 2020 and subsequently entered liquidation on 03 December 2020 with deficiency of £116,821.
