Conduct: On 01 August 2020 Sajjad Akhtar (“Mr Akhtar”) caused AFF Enterprises Limited (“AFFEL”) to breach the terms and conditions of the Government-backed Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application resulting in AFFEL receiving more funds from the BBL scheme than it was entitled to, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the 2019 calendar year. • AFFEL was incorporated on 27 January 2016, however commenced trading on 27 January 2018. • On 01 August 2020 Mr Akhtar made a BBL application on behalf of AFFEL in the amount of £50,000, declaring AFFEL’s turnover for the 2019 calendar year to be £280,000. • AFFEL’s accounts for the years ended 31 January 2019 and 31 January 2020 show turnover of £121,477 and £115,931 respectively. AFFEL was entitled to a maximum BBL of £30,369, and therefore obtained £19,631 more BBL funds that it was entitled to. • The BBL of £50,000 was paid into AFFEL’s bank account on 12 August 2020. • AFFEL entered Creditors Voluntary Liquidation on 11 April 2023 with liabilities totalling £61,137 of which £50,541 related to the BBL.
