Conduct: Mr Thompson caused AJ (Plymouth) Ltd (AJP) to breach the terms of the Bounce Back Loan (“BBL”) scheme by applying for a second BBL having previously obtained a BBL for £50,000 on 12 May 2020 from a different lender. Mr Thompson knew or ought to have known that AJP was not entitled to the second BBL. In that: • Under the BBL scheme a business was able to apply for up to 25% of its turnover to a maximum of £50,000. The BBL application was self-certified by the applicant and only one loan was permissible per business. • On 12 May 2020 Mr Thompson on behalf of AJP applied for a BBL of £50,000 from Bank A. The BBL funds were paid by Bank A into AJP’s bank account on 15 May 2020. • On 30 June 2020 Mr Thompson on behalf of AJP applied for a second BBL of £50,000 from a different lender, Bank B. The BBL funds were paid by Bank B to AJP on 02 July 2020. • The BBL terms and conditions in respect of Bank A and Bank B required the applicant to self-declare that they had not made any other application for a Bounce Back Loan for the business. In signing the Bank B BBL application, Mr Thompson falsely declared that AJP had not previously applied for and obtained a BBL with another lender. • A Winding up Order was made against AJP on 23 November 2022. • The Official Receiver’s List of Creditors, dated 24 June 2024, show total liabilities of £673,781.17. • Both Bank A and Bank B have provided BBL statements showing the balance owed in respect of the BBLs as £48,720.24 and £50,226.03, respectively.
