Conduct: Ashraf Nageeb Khalifa Mahgoub (“Mr Mahgoub”) caused Sudanpreneur Ltd (“Sudan”) to apply for and receive a £50,000 bounce back loan (BBL) when he knew or ought to have known that the company was not eligible for a BBL and has failed to provide evidence to show the funds were used in the entirety for the economic benefit of the business as required. In that: • Sudan was incorporated on 29 December 2015 • Sudan submitted dormant accounts at companies house from incorporation, with the last dormant accounts being made up to 31 December 2021 • Sudan applied for a BBL on 20 August 2020 with the BBL application form being signed by Mr Mahgoub • The company’s annual turnover was stated as being £215,000 • The company received a £50,000 BBL on 21 August 2020 into its Metro bank account • Under the terms of the BBL loan scheme, in order to be eligible for a BBL the company needed to be carrying on business as at 1 March 2020 and engaged in trading or commercial activity at the date of the application • The company never traded so was not eligible for the £50,000 BBL. It also had no turnover as it was a dormant company • Following receipt of the loan on 21 August 2020, on 22 August 2020 £25,000 was paid to two individuals. No records have been delivered up to show that these payments were for the economic benefit of the business. • At liquidation on 29 November 2022 the £50,000 BBL was still outstanding
