Conduct: On 14 May 2020, Mrs Surinder Kaur Saggu (“Mrs Saggu”) caused EWI BW Limited (“EWI”) to make a Bounce Back Loan (“BBL”) application of £50,000 when she knew or ought to have known that EWI was not entitled for a BBL of that amount. Mrs Saggu made a wrongful declaration on the BBL application using an overstated turnover figure of £200,000. As a result, EWI received more BBL funds than it was entitled to, in that: • The terms of the BBL Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover. • EWI was incorporated on 16 December 2015, commenced trading around December 2015. EWI was therefore required to provide turnover for the calendar year 2019 when applying for a BBL. • EWI’s Year-End 31 December 2018 accounts, approved by Mrs Saggu on 19 September 2019, show turnover was £NIL. • EWI’s Year-End 31 December 2019 accounts, approved by Mrs Saggu on 29 September 2020, show turnover was £NIL. • On 14 May 2020, Mrs Saggu applied for a BBL of £50,000 on behalf of EWI. On the BBL application, Mrs Saggu stated the turnover for the 2019 calendar year was £200,000. • On 22 May 2020, EWI received a BBL of £50,000. • Analysis of EWI’s bank account shows that EWI had credits of £103,683 for the calendar year 2019 resulting in EWI receiving BBL funds of at least £24,079 more than it was eligible for. • Total liabilities at Liquidation amount to £43,534 of which the entirety of the liabilities were made up of the outstanding BBL.
