Conduct: Dadalla Lanumodara Rasangika Kumarage (Ms Kumarage) caused B2B Tills Limited (B2B) to breach the conditions of the Bounce Back Loan (BBL) scheme on 16 May 2020 by applying for a second BBL of £50,000 when she knew or ought to have known that B2B was not entitled to the loan having previously applied for and received a BBL of £50,000 on 06 May 2020, in that: • Under the BBL scheme businesses were able to apply for a single BBL up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. • Accounting records for YE 30 November 2019 show that B2B had a turnover of £371,560. • Ms Kumarage made an application for a BBL of £50,000 from Bank A on behalf of B2B stating B2B’s turnover to be £400,000. The BBL funds were paid into B2B’s bank account on 06 May 2020. • Ms Kumarage made a second BBL application of £50,000 from Bank B on behalf of B2B on 16 May 2020 and signed the declaration confirming that B2B had not received any other BBL.? • The funds from B2B’s second application were paid into B2B’s bank account on 18 May 2020. • Under the terms and conditions of the BBL scheme B2B was entitled to apply for a single BBL. B2B applied for and received two BBLs totalling £100,000 and in so doing received £50,000 more than it was entitled under the BBL scheme. • B2B’s total liabilities at liquidation amount to £148,500 of which £100,000 relates to the amount owed for the 2 BBL’s.
