Conduct: On or around 21 September 2020, Janusz Owczarek (“Mr Owczarek”) caused JADR Ltd (“JADR”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in JADR obtaining a BBL that was for at least £42,251 more than it was entitled to. Mr Owczarek caused JADR to expend £47,640 of the BBL funds for purposes that did not provide economic benefit to JADR, in breach of the BBL terms and conditions. In that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. JADR was incorporated on 21 October 2015. On or around 21 September 2020, Mr Owczarek applied for a BBL of £50,000 on behalf of JADR, declaring that its turnover for the calendar year 2019 was £200,000. Accounts for period ended 31 October 2019 approved by Mr Owczarek on 15 July 2020, disclose turnover of £23,835. Bank statements for the period 1 November 2019 to 31 December 2019 show receipts into the bank account of £7,162. Therefore, JADR’s turnover for the calendar year 2019 was a maximum of £30,997. JADR received the BBL funds of £50,000 on 21 September 2020. Between 21 September 2020 and 30 October 2020, Mr Owczarek caused JADR to pay at least £47,640 of the BBL funds to himself. Total liabilities at liquidation/administration amount to £63,618 of which £48,353 relates to the amount owed in respect of the BBL.
