Conduct: Mr Mike Neri (“Mr Neri”) caused Harvest Ent Ltd (“HEL”) to apply for 2 Government backed Bounce Back Loans (“BBL”) of £50,000 each that it was not eligible for, having obtained a previous BBL for £50,000 on 11 June 2020 from a different lender, in that: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover during the calendar year 2019 to a maximum of £50,000. Only one loan was available to businesses and the applicant was required to confirm that it was their only application. • On 10 June 2020 Mr Neri applied for a BBL of £50,000 from Bank A on behalf of HEL which was paid into the company bank account on 11 June 2020. • On 30 June 2020 Mr Neri applied for a second BBL of £50,000.00 from a different lender, Bank B and it was paid to the company on 11 July 2020. • On 14 September 2020 Mr Neri applied for a third BBL of £50,000 from another different lender, Bank C, which was paid to the company, although the exact date is not known. • The BBL terms and conditions in respect of ‘Bank B’ and ‘Bank C’ required the applicant to self-declare that they had not made any other application for a Bounce Back Loan for the business. Mr Neri falsely declared that HEL had not previously applied for and obtained a BBL with another lender. • HEL entered Creditors Voluntary Liquidation on 20 February 2023. • At liquidation, HEL had liabilities of £706,798.02. This does not include the £151,779.52 owed in respect of the three BBLs as Mr Neri failed to disclose any of them to the liquidator of HEL.
