Conduct: On 11 September 2020 Mr Ardian Alija (“Mr Alija”) caused Buildersexperts1 Limited (“BE1”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, when he knew or ought to have known that BE1 was not entitled to the BBL amount received. As a result, BE1 received more funds than it was entitled to from the BBL scheme. Furthermore, Mr Alija failed to ensure that funds obtained from the BBL scheme were used for the economic benefit of BE1, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019, it was their estimated annual turnover from the date the business was started.  • BE1 was incorporated on 23 September 2015. Therefore, the turnover figure stated on the BBL application form should have been BE1’s turnover for the calendar year 2019.  • On 11 September 2020, Mr Alija caused BE1 to apply for a BBL of £50,000 declaring that its turnover was £256,000. • The bank statements and accounts for BE1 show that the company turnover for the calendar year 2019 was no more than £60,566, BE1 would have been entitled to a BBL of no more than £15,142. • Mr Alija has not provided any documentary evidence to support the given turnover figure of £256,000 or to show that BE1 was entitled to apply for a BBL of £50,000. • BE1 received BBL funds of at least £34,858 to which it was not entitled • BE1 received BBL funds of £50,000 on 22 September 2020. • Prior to the receipt of the BBL funds, the balance in BE1’s account was £4.76DR • Between 28 September 2020 and 19 October 2020, £32,520 was transferred to him. During this period, no trading income was received. • Mr Alija has failed to provide explanations and evidence to show that these transfers were used for the economic benefit of BE1. • Repayments were made to the BBL totalling £17,293. • BE1 entered Creditors voluntary liquidation on 28 June 2024 with total liabilities of £47,385 of which £32,485 was owed in respect of the BBL.
