Conduct: On 26 May 2020 David Aliu (“Mr Aliu”) caused Sparky People Ltd (“Sparky People”) to make a Bounce Back Loan (“BBL”) application of £50,000 which he knew or ought to have known did not meet the terms of the scheme. Mr Aliu made a wrongful declaration by overstating Sparky People’s turnover, as a result Sparky People has received more funds than it was entitled to from the BBL scheme. In that: Sparky People was incorporated on 01 September 2015. A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019. On 26 May 2020 Mr Aliu applied for a BBL on behalf of Sparky People of £50,000 and stated the annual turnover for Sparky People for 2019 was £250,000. Bank statements for the year 2019, show turnover of £121,871 into the company account. Therefore, the company was entitled to a maximum BBL of £30,467 Financial Accounts for year-ended 30/09/2019 showed a turnover of £106,222. On 29 May 2020, a BBL of £50,000 was paid into Sparky People’s bank account. On 30 June 2022, Sparky People entered Creditors Voluntary Liquidation with known liabilities of £50,525, owed in respect of the BBL.
