Conduct: On 5 May 2020 Mr Dean Twist (“Mr Twist”) caused Twisty Limited (“TL”) to make an application for a second Bounce Back Loan (“BBL”) of £25,000 contrary to the terms and conditions of the scheme in that: Under the BBL scheme businesses were able to apply for up to 25% of their turnover for calendar year 2019 to a maximum of £50,000. Only one BBL per business was permissible. Financial accounts year ending 31 August 2019 show turnover of £85,637. Financial accounts year ending 31 August 2020 show turnover of £44,784. On 5 May 2020 Mr Twist made 2 applications for a BBL with 2 different banks on behalf of TL declaring turnover of £120,000 on each application and requesting a BBL of £20,000 from bank A and £25,000 from bank B. Mr Twist signed the declarations on both application forms and BBL agreements on 05 May 2020 confirming that TL had not already obtained a BBL or was in the process of applying for a BBL. Bank A BBL funds of £20,000 were received into TL’s bank account on 6 May 2020. Bank B BBL funds of £25,000 were received into TL’s bank account on 10 May 2020. Total liabilities at liquidation amount to £106,110, £37,803 of which relates to the BBL.
