Conduct: Galena Dimitrova Radeva (“Mrs Radeva”) caused Gabi Décor Ltd (“GDL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, resulting in GDL receiving more funds than it was entitled to from the BBL scheme, in that:?? A company could apply for a BBL of up to 25% of its turnover for either the 2019 calendar year or, if it started to trade on or after 01 January 2019, it could estimate its turnover for the calendar year from the date it started to trade. GDL was incorporated on 20 August 2015, and Mrs Radeva was appointed as the sole Director on 01 April 2016. Bank statements record income paid to GDL’s bank account from January – December 2019 which totalled £133,908.49. Financial accounts for the year end 31 March 2020, record turnover as £159,630. On 08 May 2020, Mrs Radeva applied for a BBL of £30,000 and, in breach of the terms and conditions of the BBL scheme, self-certified that GDL had a turnover of £300,000 during the 2019 calendar year. On 10 November 2020, the British Business bank announced a BBL top-up scheme. On 12 November 2020, GDL applied for a top-up BBL and received a further £20,000 (at least £16,523 of which it was not entitled to) as a result of the overstatement of turnover in its original BBL application. A BBL statement dated 05 May 2021 records a BBL debt of £50,000. GDL entered Creditors’ Voluntary Liquidation on 16 March 2022. Total liabilities at liquidation amount to £90,397 of which approximately £50,000 relates to the amount owed in respect of the BBL.
