Conduct: Brian Paul Campbell (“Mr Campbell”) caused Continental Contracting (Europe) Limited (“Continental”) to trade to the detriment of HM Revenue & Customs (“HMRC”), in relation to PAYE/NIC, from 22/05/2016, in that: Continental provided manpower services for various companies, including companies of which he was also a director. For tax year 2016/17 Continental submitted RTI tax returns of £48,589 and made payments of £21,692 towards this liability. £26,897 remained outstanding. For tax year 2017/18 Continental submitted RTI tax returns of £41,366. No payments were made towards this liability. For tax year 2018/19 Continental submitted 2 months of RTI tax returns of £4,213. No payments were made towards this liability. The outstanding liability for PAYE and NIC for tax year 2016/17, 2017/18 and 2018/19 totalled £72,476. Continental incurred late filing penalty of £500 and interest of £35 that remained outstanding. Comparable Treatment Bank statements show during the period 18/05/2016 to 27/04/2018 £883,517 was paid out of Continental’s bank account of which £45,838 was paid to HMRC and £23,600 was claimed from HMRC. At liquidation HMRC stated the amount due to them was £74,350 (adjusted for cessation of trading and including VAT and Corporation tax penalties) whilst the liability to other creditors was £2,500.
