Conduct: Mr Nitesh Mall (“Mr Mall”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing HMHS SOLUTIONS LIMITED (“HMHS”) to overstate its turnover on its application for a BBL resulting in HMHS receiving a BBL of £50,000. As a result, HMHS received £43,824 more than it was entitled to, in that: • Under the BBL scheme, businesses trading before January 2019 could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 • HMHS was incorporated on 12 August 2015 and commenced trading around that time. • On or around 5 June 2020 Mr Mall applied for a BBL of £50,000 on behalf of HMHS declaring that turnover was £250,000. • Financial accounts for year ending 31 August 2019, which were filed at Companies House on 16 January 2020, show that the actual turnover was £25,038. • Bank accounts statements for calendar year 2019 show credits into the account total £24,703. • Mr Mall has estimated that turnover for the 2019 calendar year was £250,000. • On 8 June 2020 HMHS received £50,000 into its bank account. • The overstatement of turnover meant that HMHS received £43,824 more than it was entitled to from the BBL scheme • Repayments totalling £5,587 have been made on the BBL account. • HMHS entered Creditors’ Voluntary Liquidation on 21 February 2023 • Total liabilities at liquidation amount to £419,647 of which £46,317 relates to the amount owed in respect of the BBL.
