Conduct: Allegation: Jane Clarke (“Ms Clarke”) caused NBJC One Limited (“NBJC One”) and NBJC Two Limited (“NBJC Two”), trading as a group of companies, Nourish by Jane Clarke (“Nourish”), to apply for two Bounce Back Loans (“BBL”) of £50,000 each, when she knew or ought to have known that Nourish was only eligible for one BBL under the terms of the BBL Scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the application. The turnover figure required was that for the calendar year 2019. The business (and any wider group of which it was part, defined by having a holding company at the top of the structure) should not already have been in the process of applying for or be in receipt of a BBL. • The BBL application form stated, “For businesses which are part of a broader group, please state your group’s turnover”. • NBJC One was incorporated on 20 June 2015 and was the holding company for the investment into Nourish • NBJC Two was the trading company for Nourish, Ms Clarke was the only registered director of NBJC Two between 20 June 2015 and 3 October 2020. • On 21 July 2020, Ms Clarke applied for a £50,000 BBL from Bank 1 for NBJC One. • On 22 July 2020, Ms Clarke applied for a £50,000 BBL from Bank 1 for NBJC Two. • Obtaining two BBLs for Nourish totalling £100,000 was contrary to the conditions of the BBL scheme. • At liquidation NBJC One had liabilities totalling £985,940 of which £49,259 was in respect of the BBL and NBJC Two had liabilities totalling £1,020,451 of which £49,075 was in respect of the BBL.
