Conduct: On 07 August 2020, Sophie Louise Pittaway (“Ms Pittaway”) caused Kick Academy Limited (“Kick Academy”) to apply for a Bounce Back Loan (“BBL”) of £43,750 at a time when she knew, or ought to have known, that Kick Academy was ineligible to apply for the BBL funds as it did not meet the BBL Scheme criteria; in that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic; • Kick Academy was incorporated on 15 June 2015; • Kick Academy filed dormant accounts for years ending 30 June 2019 and 30 June 2020; • On 07 August 2020, Kick Academy obtained a BBL of £43,750 with Ms Pittaway declaring that Kick Academy had been carrying on business before 01 March 2020; • Bank statements for Kick Academy’s current account show there is no evidence of carrying on business prior to the BBL application; • Kick Academy was placed into Creditors Voluntary Liquidation on 18 March 2024; • Total estimated liabilities at liquidation amount to £44,624 of which £39,342 relates to the amount owed in respect of the BBL.
