Conduct: Janusz Kostrzewa (“Mr Kostrzewa”) breached the terms of the government backed Bounce Back Loan (“BBL”) scheme by causing JK GBS Ltd (“JK”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, that JK was not eligible for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started. • JK was incorporated on 11 June 2015. • Mr Kostrzewa declared on the company’s BBL application form an annual turnover of £200,000, and consequently on 14 October 2020 JK received a £50,000 BBL, the maximum available under the BBL scheme. • Bank statements between 21 January 2019 and 20 January 2020 show total deposits that could be attributed to business income of £53,924.49. • This would have meant that JK would have been eligible to apply for a BBL of £13,482. • The overstatement of turnover meant that JK received at least £36,518 more than it was entitled to from the BBL scheme. • JK entered Creditor’s Voluntary Liquidation on 10 October 2024. • At liquidation, JK had liabilities totalling £46,301.37, of which £41,733.37 was owed to the bank in respect of the BBL.
