Conduct: On 11 May 2020, Bhupinder Singh Multani (“Mr Multani”) caused Skylark Steam Laundry Limited (“Skylark”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000, using an overstated estimated turnover figure, when he knew, or ought to have known, that Skylark was only eligible for a loan to a maximum amount of £10,026, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant and the BBL funds were only be used to provide an economic benefit to the business and not for any personal benefit. • Skylark was incorporated on 4 June 2015 but did not commence trading until May 2019. • Mr Multani was appointed as sole director on 4 June 2015 and remained so until Liquidation. • On 11 May 2020, Mr Multani applied for a BBL of £50,000 on behalf of Skylark, stating in the application that Skylark’s estimated turnover for the calendar year 2019 was £200,000. • Company: o bank statements from 14 June 2019 to the day of the BBL application (11 May 2020) show estimated turnover of £30,193.48, which equates to an estimated turnover of £33,195 for a 365-day period. o accounts for the Years Ended 31 May 2019 and 31 May 2020 declare turnover of £0 and £40,102 respectively o therefore, based on the highest (£40,102) of these figures, the maximum BBL that could be obtained was £10,026. • on 12 May 2020, funds of £50,000 were credited to Skylark’s bank account. • Skylark therefore received BBL funds of £39,974 more that it was entitled to. • At the date of Liquidation on 13 August 2024, total liabilities amounted to £60,221, of which £33,542 was in respect of the BBL.
