Conduct: Mr Tarlochan Singh breached his duties as a director of The Gurkha Spice Limited (“Gurkha”) by failing to ensure that it complied with legislative requirements in that: • Gurkha did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 by employing 2 illegal workers; • Following a visit from Home Office Immigration Officers on 23 January 2020, during which this breach was discovered, Gurkha was found to have employed 2 persons who did not have the right to work in the UK. One worker had been employed as a chef for 8 months at £400pw plus food and accommodation and the other worker had been employed as a waiter at £40 per night at 3 nights per week. • On 23 January 2020 Mr T Singh of Gurkha was issued with a Referral Notice of illegal working for 2 workers. • On 30 January 2020 an information request was sent to the company but no response was received. • On 27 April 2020 Mr Singh completed and signed a Statement of Affairs for the purposes of Creditors’ Voluntary Liquidation on 11 May 2020. The Statement of Affairs included a fine owed to Immigration and Enforcement. • Home Office Immigration and Enforcement state they were due to issue a Civil Penalty Notice for £30,000 but because of the liquidation they instead issued a No Action Notice to the company on 10 November 2020. The liquidation does not negate the breach of the legislation by employing 2 illegal workers. • Mr Singh was in office as a director of the company at the time of the Home Office visit, the £30,000 for the breach of The Immigration, Asylum and Nationality Act 2006 is a provable debt in the liquidation and remains unpaid.
