Conduct: Miss Ndidiamaka Theresa Anolue (‘Miss Anolue’) caused D-Amaka Global Ltd (‘DAG’) to breach the terms and conditions of the Bounce Back Loan (‘BBL’) scheme by failing to use the funds obtained from the BBL scheme for the economic benefit of DAG, in that: • The British Business Bank required lenders to apply a similar set of terms and conditions to all loans offered under the BBL scheme and requested that applicants, in signing the application form, agreed with certain declarations. • One of the declarations made by Miss Anolue in signing the BBL application was “I/We undertake to use the credit granted based on this agreement only to provide economic benefit to my/our business, for example, providing working capital, or investing in my/our business. I/We also confirm that the Bounce Back Loan will be used wholly for business purposes and not personal purposes”. • On 07 May 2020, Miss Anolue applied for a £45,000 BBL, and DAG received the loan funds in its bank account on 15 May 2020. Prior to this receipt, the balance of the account was £563. Between 17 May 2020 & 20 May 2020, DAG transferred £40,000 to a dormant connected company of which Miss Anolue was the sole Director. • Between 17 May 2020 & 20 May 2020, DAG received no trading income, • Miss Anolue has not been able to provide evidence to show that the £40,000 transferred to the connected company was for the economic benefit of DAG. • On 17 August 2022 DAG was wound up in the High Court of Justice Business and Property Court of England and Wales with total liabilities of £314,949. The full amount of the BBL remains outstanding.
