Conduct: Mohammed Imran Hussain (‘Mr Hussain’) breached his duties as a director of Ballroom (Cheltenham) Limited t/as Ballroom Indian Kitchen (‘BCL’) by failing to ensure that BCL complied with its legislative duties, in that: • BCL did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006, resulting in the employment of one individual who did not have the right to work in the UK; • Home Office Immigration Enforcement (“HOIE”) after investigating BCL issued a Notification of Liability for a Civil Penalty of £15,000 in respect of the employment of the illegal worker, payment of which was due on or before 15 June 2022; • BCL has not paid the penalty due to HOIE; • Mr Hussain was the sole appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation.
