Conduct: Shiper Rezaul Karim (“Mr Karim”), whilst acting as the company director prior to his appointment on 3 January 2018, caused Tandoor Mahal (Maidstone) Ltd (“Tandoor”) to submit inaccurate Value Added Tax (“VAT”) returns to Her Majesty’s Revenue & Customs (“HMRC”) for the periods ending 30 June 2015 to 31 March 2018, by the deliberate suppression of sales income. Mr Karim failed to ensure that Tandoor submitted VAT returns for the periods ending 31 September 2018 to 31 December 2019 and caused Tandoor to trade to the detriment of HMRC from at least 7 May 2017 to liquidation, in that: - • You acted as the company’s director during the allegation period, prior to your formal appointment as a de jure director of the company on 3 January 2018. • Following test meals visits and a review of Tandoor’s accounting records HMRC raised additional VAT assessments totalling £89,056.13 including interest and civil penalties in respect of the VAT periods ending 30 June 2015 to 31 March 2018. • VAT returns record accrued VAT liabilities of £27,740.88 of which £23,106.87 was unpaid and overdue for the 4 VAT return periods ending 31 March 2017 to 31 December 2017. The £23,106.87 remaining outstanding at the date of Tandoor’s liquidation. • Late VAT returns for the next 2 VAT periods ending 31 March 2018 and 30 June 2018 disclosed VAT liabilities totalling £14,010.07. No payment was made on account of this liability. • In the absence of the VAT returns for periods ending 31 September 2018 to 31 December 2019 HMRC raised an estimated assessment in the amount of £41,746.00. No payment was made on account of this liability. • As a consequence of the failure to make payment of the VAT liabilities, HMRC raised default surcharges of £9,239.98 of which £7,426.65 was incurred after 3 January 2018. No payment was made on account of this liability. • Direct Taxes totalling £162,634.34 was outstanding at the date of Tandoor’s liquidation. • The available bank statements show that between 2 January 2018 and liquidation, sums totalling £432,825.35 were paid into the account, whilst £433,592.01 was paid from the bank account. Of the £433,592.01 paid out of the bank account cleared sums totalling £5,600 was listed as being paid to HMRC. The remaining £427,992.01 was used to pay trade creditors, wages, director’s loans and or other operational costs.
