Conduct: Between 06 May 2020 and 14 May 2020, Mohammad Abdul Kayum Khalique (“Mr Khalique”) caused Max Business Ltd (“the Company”) to provide information which he knew, or ought to have known, was false, by providing inaccurate turnover information in Bounce Back Loan applications. In addition, Mr Khalique caused the Company to breach the terms and conditions of the BBL facility by applying for and obtaining a second BBL of £50,000, having already received a BBL of £50,000, and also caused the Company to expend £45,177 of BBL funds received for purposes that did not provide economic benefit to the Company, in that:     • Under the BBL scheme businesses were able to apply for up to 25% of their calendar year 2019 turnover, to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.   • Accounting records for calendar year 2019 show turnover of £68,845, meaning the Company was eligible for a BBL of no more than £16,211.   • Mr Khalique made an application for a BBL of £50,000 on behalf of the Company on 06 May 2020, declaring turnover for calendar year 2019 of £203,000. The BBL funds of £50,000 were paid into the Company bank account on 10 May 2020, before being transferred to Mr Khalique on the same day.      • Mr Khalique made a further BBL application for £50,000 on behalf of the Company on 11 May 2020, declaring turnover for calendar year 2019 of £203,000.     • As part of the second application, Mr Khalique was required to declare that the Company had not received any other BBL, when Mr Khalique knew that this was untrue.    • The funds of £50,000 from the Company’s second BBL were paid into its bank account on 14 May 2020. On the same day, the full £50,000 was transferred to Mr Khalique. • Following the £100,000 transferred to Mr Khalique from the BBL funds, Mr Khalique made payments into the bank account of the company, or on behalf of the company, totalling £54,823. As a result £45,177 of the BBL funds received by the Company were not used for the economic benefit of the Company. • The maximum BBL available under the scheme to any business was £50,000, and the maximum available to the Company based on its turnover was £16,211. Mr Khalique’s actions caused the Company to receive BBL funds of £83,789 that it was not eligible for.   • Total liabilities at liquidation amount to £254,531, of which £96,236 relates to amounts owed in respect of the 2 BBLs.
