Conduct: Catherine Mudoti (‘Ms Mudoti’) caused C G Services (Surrey) Ltd (‘CG’) to falsely obtain a second Government-backed Bounce Back Loan (‘BBL’) totalling £17,000 when only one BBL was permissible per business. The obtaining of the second BBL was contrary to the conditions of the scheme. Further it was a requirement of the BBL scheme that loans were used for the economic benefit of a company, however Mrs Mudoti has failed to provide evidence that total BBL funds of £34,500 were used for the economic benefit of CG. In that: • In the BBL application form, the applicant had to declare that the company was not in the process of applying for or had already received a Bounce Back Loan. • On 15 June 2020 CG obtained a BBL of £17,500 from Bank A. On 23 August 2020 Ms Mudoti signed an application for a second BBL from another bank (Bank B) and on 26 August 2020 an amount of £17,000 was paid into that account. Obtaining 2 BBL’s was contrary to the conditions of the BBL scheme. • Following the receipt of the BBL loans of £34,500, a total of £19,703 was paid to Ms Mudoti’s personal account. The remaining £14,797 was utilised as follows: £1,850 in cash withdrawals, £224.20 to fast food/restaurants/cafes, £219.75 for mobile phones, £5,477 to third parties, £268.80 for flights, £150 to Eithopia, £921.66 to World Remit and £1,813.76 for retail shopping. No evidence has been provided to show that the above transactions have been utilised for the sole economic benefit of the Company.
