Conduct: On 05 June 2020, Enode Adebayo (Mrs Adebayo) caused Enode Kabit Care Ltd (EKC) to breach the terms and conditions (T&Cs) of the bounce back loan (BBL) scheme by overstating the annual turnover of EKC in a BBL application form, causing EKC to receive a larger BBL than it was entitled to, in that: • The BBL scheme allowed applicants to apply for a loan between £2,000 and £50,000, with an individual upper limit of 25% of the turnover stated by the applicant • BBL applications included the T&Cs of the BBL scheme which stipulated that, for companies like EKC which were in business before 01 January 2019, the applicant was required to state its turnover from 01 January 2019 to 31 December 2019. • The company was incorporated on 3 March 2015. • Bank statements for EKC record deposits amounting to £37,692 during 2019. Based on this turnover an appropriate BBL would be £9,423 • On 05 June 2020 Mrs Adebayo applied for a BBL of £50,000, stating that the 2019 turnover of EKC was £202,500. As a result, EKC received £40,577 more than it should have done. • On 31 January 2023, EKC entered liquidation with the BBL lender as its sole known creditor.
