Conduct: Talib Hussain (“Mr Hussain”) breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Zohib Limited (“Zohib”) to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that Zohib did not meet the eligibility criteria to obtain a BBL of that amount, in that, • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated annual turnover. • Zohib Limited was incorporated on 27 February 2015. • The company’s financial accounts for the year ending February 2019 declared turnover of £17,196. • The financial accounts for the year ending February 2020 declared turnover of £5,800. • At best, the company was eligible to apply for a maximum BBL of £5,749 based on turnover of £22,996 (being a total of £17,196 and £5,800). • On 13 August 2020, Mr Hussain applied for a BBL of £50,000, on behalf of Zohib declaring that turnover was £248,500. • On 14 August 2020, BBL funds of £50,000 were received into the company’s bank account, this was at least £44,251 more than it was entitled to. • On 24 November 2022, Zohib Limited entered into creditors voluntary liquidation. • Total liabilities at liquidation amount to £50,641, of which £49,441 is in respect of the BBL.
