Conduct: On 6 May 2020, Graham Gardner (“Mr Gardner”) caused Waterfield Dudley Limited (“Waterfield”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000, using overstated turnover figures, when he knew, or ought to have known, that Waterfield was only eligible for a loan to a maximum amount of £2,725, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant and the BBL funds were only be used to provide an economic benefit to the business and not for any personal benefit. • Waterfield was incorporated on 26 February 2015. • Mr Gardner was appointed as a director on 29 May 2015 and became sole director on 12 August 2015 (remaining so until Liquidation). • On 6 May 2020, Mr Gardner applied for a BBL of £50,000 on behalf of Waterfield, stating in the application that Waterfield’s turnover for the calendar year 2019 was £375,000. • Company accounts for the Years Ended 31 August 2019 (a period of circa 18 months from 1 March 2018 to 31 August 2019) and 31 August 2020 declare turnover of £10,899 and £0 respectively, therefore based on the higher of these two figures, the maximum BBL that could be obtained was £2,725. • on 20 May 2020, funds of £50,000 were credited to Waterfield’s bank account. • Waterfield therefore received BBL funds of £47,275 more that it was entitled to. • At the date of the Winding Up Order on 17 July 2024, total liabilities amounted to £1,278,574.91, of which £40,305.47 was in respect of the BBL.
