Conduct: On 17 July 2020, you caused Fair Auto Trader Limited (“the Company”) to make a false declaration when applying for a Bounce Back Loan (“BBL”) of £50,000 to which the Company was not entitled. From the BBL funds received on 20 July 2020, you caused the Company to make payments totalling £42,980 that were not for the economic benefit of the Company and contrary to the terms and conditions of the BBL scheme, in that: ? Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The turnover figure was self-certified by the applicant. ? You applied for a BBL of £50,000 on 17 July 2020 on behalf of the Company, stating a turnover of £220,000 and declaring that the Company was carrying on its business on 01 March 2020 and engaged in trading or commercial activity in the United Kingdom as at the date of the application. ? The Company was incorporated on 24 February 2015. The Company provided no records to its accountant, who confirmed that no trading activity was reflected in any of the filed accounts. There is no evidence that the Company was carrying on its business at 01 March 2020, nor engaged in trading or commercial activity as at the of the BBL application. As such it was not eligible for a BBL of any amount ? The BBL funds were paid into the Company account on 20 July 2020, which was the same day that the account was opened. The BBL funds were the only funds in the account on that date. ? Following receipt of the BBL funds, between 20 July 2020 and 06 August 2020 the Company made 10 payments totalling £42,980 to me which were not for the economic benefit of the Company, contrary to the terms and conditions of the BBL scheme. ? The Company made one repayment in respect of the BBL in the sum of £887.37 on 20August 2021. At liquidation, the BBL provider has lodged a claim in the proceedings which, inclusive of interest, amounts to £49,873.08.
