Conduct: On 12 May 2020 Safdar Hussain (“Mr Hussain”) applied for and obtained a Government-backed Bounce Back Loan (“BBL”) of £50,000 for Pure Fitness Ladies Only Gym Limited (“Pure”) by providing false or knowingly inaccurate information regarding Pure’s turnover, thereby causing it to obtain at least £41,686 in BBL funding to which it was not entitled. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000; • Pure was incorporated on 12 February 2015 and prepared and filed trading accounts to 28 February in each of the years from 2016 to 2020. • As Pure was trading throughout 2019, it was required to specify actual turnover for the calendar year 2019 for the BBL application. On 12 May 2020 Mr Hussain applied for a BBL of £50,000 and specified estimated turnover of £200,000. • Accounts for the years to 28 February 2019 and 28 February 2020 disclose turnover of, respectively, £32,850 and £33,256. Based on turnover in the year ended 28 February 2020, Pure was entitled to a BBL of £8,314. • Banking records show Pure’s banked income in the calendar year 2019 was £5,145. • The BBL was received into Pure’s bank account on 14 May 2020. • As at the date on which Pure entered into liquidation, the BBL lender was owed £51,062.47 out of total liabilities of £53,055.
