Conduct: Mohammed Oly Uddin (“Mr Uddin”) caused Spice Touch (Lancashire) Ltd (“Spice Touch”) to apply and obtain a Bounce Back Loan (BBL) of £50,000 in May 2020 using overstated turnover figures in the application form. Mr Uddin knew or ought to have known that Spice Touch did not meet the eligibility criteria for a BBL of that amount. Consequently, Spice Touch received £43,960 more than it was entitled to from the BBL scheme, in that: • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover in calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Spice Touch was incorporated on 30 January 2015 and began trading thereafter. • In May 2020, Mr Uddin made an application to a financial institution for a Bounce Back Loan of £50,000 on behalf of Spice Touch. • The loan application asked Spice Touch to provide details of its turnover for the 2019 calendar year. Mr Uddin stated on the application form that the turnover for Spice Touch was £228,000. • Receipts into Spice Touch’s bank account for the period 01 January 2019 to 31 December 2019 totalled £24,160. Spice Touch was therefore eligible to apply for BBL of £6,040. • The BBL funds of £50,000 were paid into the company’s bank account on 11 May 2020. • The overstatement of turnover meant that Spice Touch received £43,960 more that it was entitled to from the BBL scheme. • Spice Touch entered Creditors’ Voluntary Liquidation on 17 November 2022. • At liquidation, Spice Touch’s liabilities totalled £109,977 of which £42,392.24 is due in respect of the outstanding Bounce Back Loan.
