Conduct: On 10 December 2020, Marc Berry (“Mr Berry”) caused Monjac Services Ltd (“Monjac”) to apply for a Bounce Back Loan (“BBL”) of £40,000 that Monjac was not eligible for that amount, making a false declaration to the lender of Monjac’s turnover. In that: Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019. Monjac was incorporated on 20 January 2015 and started trading in 2017. The company’s financial accounts for the year ending March 2019 declared turnover of £82,726 and turnover of £19,830 for the year ending March 2020. The company’s bank statements show income of £56,311 was received in the 2019 calendar year. On that basis, the company was eligible to apply for a maximum BBL of £14,078. On 10 December 2020, Mr Berry applied for a £40,000 BBL on behalf of Monjac, declaring the company’s annual turnover as £162,000. On 11 December 2020, Monjac received BBL funds of £40,000 into the company’s bank account. One BBL repayment of £748.86 was made on 10 January 2022. On 8 August 2022, Monjac entered Creditors Voluntary Liquidation. Liabilities at liquidation amounted to £80,489 of which £39,291 is in respect of the BBL (£39,251 BBL and £40 interest). The remaining £41,198 relates to HMRC.
