Conduct: Mohammed Saqib Choudrey (“Mr Choudrey”) caused Legit Limited (“Legit”) to apply for and obtain a Bounce Back Loan (“BBL”) of £50,000 by making false statements on the BBL application form, when it was not entitled to apply for a loan under the terms of the BBL scheme. Mr Choudrey further failed to ensure that the BBL funds of £50,000 were used for the economic benefit of Legit, in that: • Under the terms of the BBL scheme, businesses that were established and operating before 01 March 2020 could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The guidance further stated that the applicant company must be engaged in trading or commercial activity at the date of the BBL application. • On 16 July 2020, Mr Choudrey applied for a BBL of £50,000 on behalf of Legit. • When making the BBL application, Mr Choudrey declared that Legit was carrying on its business on 01 March 2020 and that it was engaged in trading or commercial activity at the date of the application. • Legit was incorporated on 05 January 2015 but remained dormant until at least 03 June 2020, when Mr Choudrey purchased the company off the shelf. Mr Choudrey has failed to provide any evidence that Legit ever traded. • Mr Choudrey cannot have been carrying on Legit’s business on 01 March 2020 because Legit was dormant at the time and he had not yet purchased the company. • There is no evidence that Legit was engaged in trading or commercial activity at the date of the BBL application. • It was a requirement of the BBL scheme that the BBL funds were used for the economic benefit of the company. • On 24 July 2020, Mr Choudrey transferred the BBL funds of £50,000 to his own personal bank account. • No evidence has been provided showing that Legit received any economic benefit from the funds that were transferred to Mr Choudrey’s personal bank account. • At the date of liquidation, £51,103 remains outstanding in respect of the BBL.
