Conduct: On 22 June 2020, Gabriel Rozental (“Mr. Rozental”) caused Maga Trend Limited (“MTL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for a second BBL of £50,000 when he knew or ought to have known that MTL was not entitled to the loan, having previously applied for and obtained a BBL of £50,000, in that: • Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The BBL scheme eligibility criteria allowed for businesses to only receive BBL funds of £50,000 maximum, with the applicant declaring that the company was not in the process of applying for or had already received a BBL. • MTL was incorporated on 22 December 2014. • On 13 May 2020, Mr. Rozental applied for a £50,000 BBL with Bank “A” on behalf of MTL. BBL funds of £50,000 were credited into MTL’s bank account held with Bank “A” on 14 May 2020. • On 22 June 2020, Mr. Rozental applied for a second BBL of £50,000 with Bank “B” on behalf of MTL. BBL funds of £50,000 were credited into MTL’s bank account held with Bank “B” on 23 June 2020. • On the second BBL application dated 22 June 2020, Mr Rozental signed to declare that: “I/We confirm that this is my/our only application for a Bounce Back Loan for this business, and I am/we are not part of a wider group which is in the process of applying for or has already received a Bounce Back Loan”. • As a result, MTL received a BBL of £50,000 from Bank B to which it was not entitled. • On 17 December 2024, MTL entered Liquidation with liabilities totalling £319,588.58, of which £46,082.82 was owed in respect of the BBL to Bank “A” and £45,727.00 was owed in respect of the BBL to Bank “B”.
