Conduct: On 07 May 2020, Andrew Henry Hatton-Woods (“Mr Hatton-Woods”) caused or allowed South Street Homes Limited (“SSH”) to obtain a £50,000 Bounce Back Loan (“BBL”) by overstating SSH’s turnover, when he knew or ought to have known that SSH was not eligible for this amount. As a result, SSH received £37,500.00 more than it was entitled to. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated turnover could be used. • SSH was incorporated on 17 December 2014 and started trading on the same day. • On 07 May 2020, an application was made to obtain a £50,000 BBL on behalf of SSH, declaring that its turnover for the calendar year 2019 was £237,000. The funds were credited into SSH’s bank account on 11 May 2020. • Analysis of SSH’s bank account shows that between 01 January 2019 and 31 December 2019, SSH received income of £20,332.45. • Unaudited financial statements for the year ending 31 December 2019 show that SSH had a turnover of £50,000.00. • Based on the turnover declared in the financial statements for the year ending 31 December 2019, SSH was entitled to apply for a BBL of no more than £12,500. • The overstatement of turnover meant that SSH received £37,500 more than it was entitled to from the BBL scheme. • SSH entered liquidation on 24 February 2023 with liabilities totalling £73,407.00 of which at least £49,404.84 relates to the amount owed in respect of the BBL.
