Conduct: On 06 May 2020, Kashif Ali (“Mr Ali”) caused The Clothes Pen Ltd (“CP”) to apply for a government backed Bounce Back Loan (“BBL”) of £50,000 when it was not eligible for a loan of that amount, by providing information to the lender which he knew or ought to have known was inaccurate, in that: • A business could apply for a loan between £2,000 and £50,000 subject to a maximum of 25% of turnover. Where a company was established before 01 January 2019, the turnover figure required was that for the 2019 calendar year. CP was incorporated on 10 November 2014. • In the BBL application dated 06 May 2020, which was signed electronically by Kashif Ali, he stated that the annual turnover of CP was £205,000. CP received £50,000 into its bank account on 07 May 2020. • Bank statement analysis for the calendar year 2019 shows a total turnover of £67,584. Based on this figure, CP would have been eligible for a BBL of £16,896 and therefore received £33,131 more than the company was entitled to. • At liquidation on 10 October 2023, £48,355 of the BBL remained outstanding. Additionally, on 06 May 2020, Kashif Ali (“Mr Ali”) caused Gems Services Ltd (“GS”) to apply for a government backed Bounce Back Loan (“BBL”) of £50,000 when it was not eligible for a loan of that amount, by providing information to the lender which he knew or ought to have known was inaccurate, in that: • A business could apply for a loan between £2,000 and £50,000 subject to a maximum of 25% of turnover. GS received £50,000 into its bank account on 07 May 2020. • Bank statement analysis for the calendar year 2019 shows a total turnover of £101,877. Based on this figure, GS would have been eligible for a BBL of £25,469.25 and therefore received £24,530.75 more than the company was entitled to. • At liquidation on 10 October 2023, £48,355 of the BBL remained outstanding.
