Mr Sabu Miah (“Mr Miah”) caused Tajmahal Tandoori Limited (“TTL”) to obtain a government backed Bounce Back Loan of £38,750 by overstating turnover when TTL was entitled to a maximum loan of £32,560.77(“BBL1”). Furthermore, Mr Miah transferred £2,000 of the BBL1 monies to an account ending 2989 and a further £10,312.92 to his personal bank account, for no economic benefit to TTL in that: BBL1 • Mr Miah applied for BBL1 of £38,750 with Bank A on 10 July 2020. • In the BBL1 application, he stated TTL had a turnover of £155,000. • BBL1 funds were received into TTL’s Bank A account on 10 July 2020. • Prior to BBL1, the account was in deficit of -£1,725.43. • Based on bank receipts shown in the bank statements available to Mr Miah at the time of the BBL1 application, TTL would have been entitled to a maximum BBL of £32,560.77. • Between 10 July and 28 July 2020, a total of £44,967.58 was credited to the account, comprised of BBL1 funding and trading income. • On 10 July 2020 the sum of £2,000 was transferred to an account ending 2989, it is not explained what this expenditure was in respect of. • On 13 July 2020 a payment of £10,312.92 was made to Mr Miah’s personal account, the reason for payment is not explained. • Remaining BBL1 funds appear to have been dispersed for the benefit of TTL. 2. Mr Miah caused TTL to apply for and subsequently receive a second BBL of £50,000, which was in contravention of the terms and conditions of the BBL scheme (“BBL2”). Consequently, TTL received £50,000 more monies than it was entitled to from the BBL scheme. Further, Mr Miah transferred £50,000 received from the BBL2 application to his personal bank account for no economic benefit to TTL in that. BBL2 • On 01 October 2020 Mr Miah applied for BBL2 of £50,000 with Bank B, declaring that the application was his only application for a BBL for TTL, and that TTL had not already obtained a BBL. • Within the BBL2 application, he stated that the TTL had a turnover of £245,000. • BBL2 funds of £50,000 were paid into TTL’s Bank B account on 09 October 2020. • Analysis of TTL’s bank accounts show income into Bank B’s account of £130,243 for the period January to December 2019. • Prior to the BBL2 payment the account was not in credit. On 12 October 2020 the whole sum of £50,000 was transferred to Mr Miah’s personal account, the reason for payment is not explained.
