Conduct: Oliver Charles Greaves (“Mr Greaves”) caused Atlas Machinery Limited (“Atlas”) to obtain a Bounce Back Loan (“BBL”) in the sum of £48,000 by overstating Atlas’ turnover, when he knew or ought to have known, that Atlas was not entitled to that amount under the terms of the BBL Scheme. In that: • Under the BBL Scheme, a business could apply for a loan between £2,000 and £50,000, capped at 25% of its annual turnover for the calendar year 2019. Where a business was established after 1 January 2019, applicants were instructed to apply the 25% limit to their estimated annual turnover from the date the business started. • Atlas was incorporated on 3 October 2014 and commenced trading in October 2015. • Accordingly, Atlas was required to base its BBL application on its actual turnover for the 2019 calendar year. • No accounts have been prepared for 2019. • Analysis of Atlas’s bank statements confirms that the company generated total turnover of £47,337 during calendar year 2019. • On 6 May 2020, Mr Greaves completed and submitted a BBL application on behalf of Atlas in which he declared an annual turnover of £400,000. • On the basis of that declaration, Atlas received £48,000 in BBL funds on 11 May 2020. Based on its actual 2019 turnover, Atlas was entitled to a maximum BBL of approximately £11,800. • No repayments were made towards the BBL when the company entered Liquidation on 24 September 2024. • In liquidation total deficiencies were £142,000, of which £49,700 remained outstanding in respect of the BBL.
