Conduct: Kirk Whitelock (“Mr Whitelock”) caused Aberfeldy Cafe Limited (“Aberfeldy”) to overstate its turnover in an application made on 11 October 2020 for a Bounce Back Loan (“BBL”) of £50,000, and as a result obtained at least £42,200 more than Aberfedly was entitled to. Further, Mr Whitelock failed to ensure that at least £48,900 of the BBL funds were used for the economic benefit of the company, in that: • Under the BBL scheme, businesses were entitled to apply for a loan of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019. • Aberfeldy was incorporated on 24 September 2014. • Aberfeldy’s accounts for the years ended 30 September 2019 (approved by Mr Whitelock on 29 June 2020) showed turnover of £31,200. • On 11 October 2020, Mr Whitelock submitted a BBL application in which he stated that Aberfeldy’s turnover in the calendar year 2019 was £200,000. • On 12 October 2020, the BBL funds of £50,000 were deposited into Aberfeldy’s bank account. • By overstating Aberfeldy’s turnover in the BBL application, the company received £42,200 more in BBL funds than it was entitled to. • It was a requirement of the BBL scheme that the BBL funds were used for the economic benefit of the company. • Between 13 October 2020 and 28 January 2021, Mr Whitelock made round sum payments totalling £35,900 to himself and one payment of £13,000 to purchase a car. Mr Whitelock has confirmed that these payments were not for the economic benefit of the company. • At the date of liquidation, the BBL lender was owed £49,077.
