Conduct: Between 01 August 2020 to at least 17 April 2022 Rubani Ghulam caused Posh Windows UK LTD (“Posh”) to Windows UK LTD (“Posh”) to contravene regulation 21 of the Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”) in that: • Between 01 August 2020 to 30 April 2021, Posh made a total of 630,971 telephone calls. Of these telephone calls, 461,062 were to telephone numbers that had opted out of receiving such calls by being registered with the Telephone Preference Service (“TPS”) for more than 28 days, which was in breach of Regulation 21 of PECR. • Furthermore, 460,978 of the 461,062 calls made to TPS registered numbers were made from a withheld number, which was in breach of Regulation 21 of PECR. • On 24 March 2021 the Information Commissioner’s Office (“ICO”) commenced an investigation into suspected contraventions of PECR regulations by Posh. • Notwithstanding the ICO investigation, until 17 April 2022, Mr Liaqat caused Posh to continue to trade without the means to adequately screen telephone numbers against the TPS register. • On 18 July 2022 the ICO served Posh a notice of intent (“NOI”) to issue a monetary penalty. • On 01 September 2022 Posh provided representations in respect of the NOI that were considered by the ICO. • On 29 September 2022 ICO issued a monetary fine of £150,000 against Posh for the contravention of regulation 21 PECR to be paid by 31 October 2022, which remained outstanding in full at liquidation.
