Conduct: On 8 September 2020, whilst acting as a director of Kepler Homes Ltd (“Kepler”), Joao Batista Garcia De Queiroz (“Mr De Queiroz”) breached the terms of the government-back Bounce Back Loan (“BBL”) Scheme by causing Kepler to use BBL funds in a manner that was not for the economic benefit of Kepler, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, between £2,000 and a maximum of £50,000, based on 25% of the company’s turnover for the 2019 calendar year. The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • On 4 September 2020 Mr De Queiroz applied for a BBL of £50,000 on behalf of Kepler, to which Kepler was entitled. Accounts to 30 September 2019 show annual turnover of £634,414. • Bank statements show receipt of the BBL funds on 7 September 2020. • On 8 September 2020 £46,000 was transferred to Mr De Querioz in 3 payments marked ‘loan” - of £10,000, £16,000, and £20,000, respectively. • Kepler’s balance sheets on 30 September 2019 and 30 September 2020 do not show any amount due to the Director(s). Total liabilities at liquidation amount to £55,000 of which £50,000 is the outstanding BBL.
