Conduct: Between 10 July 2017 and the date of administration on 05 February 2019, Mr Mark Simon Niven (“Mr Niven”) failed to ensure that NFMN Dumfries Limited (“NFMN”) maintained and/or preserved adequate accounting records, or in the alternative he failed to deliver up adequate accounting records to the Administrator when required following the administration of NFMN. Consequently, it has not been possible to: • Determine the purpose of payments from NFMN’s bank account between 22 August 2017 and 18 December 2018 totalling £158,295 (net position of £152,895), which were made to a company Mr Niven was a registered director of from 06 February 2017 to 09 February 2019, namely NFMN Alloa Limited. Furthermore, confirm whether the payments were made in the best interests of NFMN and its creditors or whether there were any balances outstanding at administration. • Determine the purpose of payments from NFMN’s bank account on 12 January 2018 totalling £49,000 (net position of £49,000), which were made to a company with a connected individual registered as director and a company Mr Niven was a registered director of from 25 January 2018 to 28 March 2018, namely Protelhealth Limited. Furthermore, confirm whether the payments were made in the best interests of NFMN and its creditors or whether there were any balances outstanding at administration. • Determine the purpose of payments from NFMN’s bank account totalling £49,900 (net position of £45,900) to Mr Niven between 06 December 2017 and 08 August 2018 and confirm whether the payments were made in the best interests of NFMN and its creditors. • Determine the purpose of payments from NFMN’s bank account to Chrono24 dated 26 November 2018 totalling £12,573 and payments to David Lunt totalling £8,975 made between 15 February 2018 and 15 January 2019 and determine how these payments related to assets held by NFMN at administration. • Verify the position in respect of Mr Niven’s Director’s Loan Account, calculated by the Administrator in the sum of £59,297 as being owed by Mr Niven. Howard Atkins Limited investment • Establish specific details of a bridging loan investment, including what property this was in relation to, the dates of NFMN’s transactions which related to the bridging loan and confirm that the £50,000 received by NFMN on 10 July 2017 was utilised for the intended purpose as repayment of £24,000 was made by NFMN on 07 June 2018, leaving a liability at administration of £31,600. LEM Solutions Limited Investment • Establish specific details in respect of the Rolex watch investment, including details of how and from where the Rolex watches were purchased, the purchase and sale dates of the Rolex watches and confirm that the £49,450 received by NFMN on 12 January 2018 was utilised for the intended purpose as repayment of £8,705 was made by NFMN on 27 November 2018, leaving a liability at administration of £49,450. David Griffin investment • Establish specific details in respect of the Rolex watch investment, including details of how and from where the Rolex watches were purchased, the purchase and sale dates of the Rolex watches and confirm that the £50,000 received by NFMN on 29 November 2018 was utilised for the intended purpose leaving a liability at administration of £51,945.
