Conduct: Mr Atta-Ul Mustafa ("Mr Mustafa") caused A & Atta Enterprises Limited ("AAE") to apply for a Government backed Bounce Back Loan ("BBL") totalling £30,000 (and later increased by a further top-up BBL of £20,000 obtained on 11th November 2020) by overstating its turnover. As a result, AAE received more funds than it was entitled to from the BBL scheme, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started • AAE was incorporated 13 June 2014,trading prior to 01 January 2019 and therefore not entitled to use an estimated turnover when making a BBL application. • Mr Mustafa, declared in the BBL application that AAE's annual turnover in the calendar year 2019 totalled £740,000. • The financial statements for AAE for the years ending on 30 June 2019 and 30 June 2020, showed AAE had a turnover of £83,188 and £55,742 respectively for those years, • Based on the average company turnover for those years, AAE would have been entitled to receive no more than £16,624 • The BBL application submitted by AAE therefore over-stated its turnover for 2019, and as a result AAE obtained £33,376 in BBL funds that it was not entitled to • AAE entered Creditors’ Voluntary Liquidation on 21 November 2022 • The sum of £50,572 remains outstanding in respect of the BBL in AAE's liquidation.
