Conduct: On 03 July 2020 Sebastian Pniewski (“Mr Pniewski”) caused Sebtrans75 Limited (“Sebtrans”) to obtain a second Bounce Back Loan (“BBL”) of £45,000 which it was not eligible for because it had already received a £50,000 BBL on 05 May 2020. In that: • under the BBL scheme a qualifying business that was established before 01 January 2019 was able to apply for a loan of up to 25% of its turnover in the 2019 calendar year, up to a maximum of £50,000; • it was a condition of the BBL scheme that a borrower could only apply for one BBL and the borrower was required to confirm that it was their only application and that they had already received a BBL; • on 05 May 2020 Mr Pniewski obtained a BBL of £50,000 for Sebtrans; • on 03 July 2020 Mr Pniewski obtained a BBL of £45,000 for Sebtrans from another lender, of which £15,660 was used to settle Sebtrans’ existing liability to that lender and £29,340 was advanced to Sebtrans; • the second BBL remained outstanding in full when Sebtrans went into liquidation on 23 February 2023.
