Conduct: Uyi Aisien (‘Mr Aisien’) caused Flex Infusion Limited (‘FIL’) to obtain 2 Bounce Back Loans (‘BBL’) totalling £62,500 contrary to the BBL scheme’s conditions and to which it was not entitled, by knowingly providing false and inaccurate information regarding the Company’s turnover. In addition, Mr Aisien has failed to use the BBL for the economic benefit of the Company, in that: • The BBL Scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 or estimated turnover if it had been established after 01 January 2019. Bounce Back Loan Scheme conditions state that a business should not apply for a loan if it is already in the process of applying for, or has already received, a Bounce Back Loan Scheme facility, the exception being a top-up if they originally borrowed less than the maximum amount (£50,000) available. The funds are to be used for the economic benefit of the business. • FIL was incorporated on 02 June 2014. • Prepared accounts for the financial years to 30 June 2019 and 30 June 2020 disclose a turnover of £4,828 and £8,127, respectively. • FlL’s maximum possible turnover for 2019 would therefore be £12,955 which would entitle FIL to a BBL of no more than £3,239. • Mr Aisien made an application for BBL1 to Bank A, on 17 June 2020, in which he stated FIL’s turnover to be £200,000 and requesting a loan of £50,000. • BBL1 was paid into FIL’s account with Bank A on 22 June 2020. • On 07 October 2020 Mr Aisien caused the Company to apply to Bank B for a second BBL of £12,500. • The BBL terms and conditions in respect of Bank B required the applicant to self-declare that they had not made any other application for a Bounce Back Loan for the business. Mr Aisien falsely declared that FIL had not previously applied for and obtained a BBL with another lender. • BBL2 was paid into the Company’s bank account with Bank C on 08 October 2020. • FILtherefore received at least £59,261 more than that to which it was entitled. • Immediately prior to the receipt of BBL1, FIL’s account with Bank A held a credit balance of £15.91. • Between 22 June 2020 and 27 October 2020, additional income of £224.40 was received and the following transactions were made from Bank A: o payments amounting to £17,110 to Mr Aisien o £30,000 were made to a new account opened with Bank C. • This transfer of £30,000 was then paid to various third-party companies from Bank C • Mr Aisien has failed to provide documentation to show that these payments were for the economic benefit of FIL • FILentered Creditors’ Voluntary Liquidation on 22 October 2022 • At Liquidation, £62,500 was owed in respect of outstanding BBLs
