Conduct: On 20 May 2020, Mr Bogdan-Petrus Istrate, also known as Peter Istrate, ("Mr Istrate") caused Moxels Limited ("Moxels") to make a Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that Moxels was not entitled to a loan of that amount. Mr Istrate made a wrongful declaration on the BBL application using an overstated turnover figure of £200,000. As a result, Moxels received more BBL funds than it was entitled to, in that: • The terms of the Bounce Back Loan Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover.   • Moxels was incorporated on 08 May 2014 commencing trading around May 2014 and was therefore required to provide turnover for the calendar year 2019. • On 20 May 2020, Mr Istrate applied for a BBL on behalf of Moxels. He stated on the application form that Moxels had a turnover of £200,000. • On 22 May 2020, Moxels received a BBL of £50,000. • Moxels' profit and loss accounts for year ending 31 May 2019 records turnover of £50,447, and for year ending 31 May 2020 turnover of £61,561. • Analysis of the Moxels bank statements show credits totalling £91,513 in the calendar year of 2019, based on which Moxels received BBL funds of at least £27,122 more than it was eligible for. • Total liabilities at Liquidation amount to £49,906 of which at least £37,783 relates to the amount owed in respect of the BBL.
