Conduct: Anthony Frederick SULLMAN caused false information to be submitted in an application he signed and that was made on behalf of Barker Medicals Supply Limited (“BMSL”) for a Bounce Back Loan in the amount of £50,000 with the consequence that BMSL received a Bounce Back Loan on 8 May 2020 for a sum greater than it was entitled to, in that: In the application for the Bounce Back Loan (“BBL”) Mr Sullman certified that BMSL’s turnover for the calendar year to 31 December 2021 was £312,250; Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover; According to its accounting records the maximum amount that could hae been invoiced by BMSL for the period 1 January 2019 to 31 July 2020 was £51,506, which would have supported a Bounce Back Loan up to a maximum of £12,877; On or around 10 October 2018 BMSL informed HMRC that the company would not be making any future sales and since that date BMSL submitted nil VAT returns. And Between 5 July 2020 and 31 July Mr Sullman caused BMLS to make payments that were not for the economic benefit of BMLS, contrary to the terms of the BBL agreement, and that were to the detriment of the general body of BMLS’s creditors in that: On 8 May 2020 BMSL received a BBL of £50,000 from HSBC UK Bank plc. On 31 July 2020 BMSL received £21,962 from HMRC with the reference “HMRC COTAX”. On 5 July 2020 BMSL Mr Sullman caused BMLS to make a payment of £10,808.25 in settlement of a personal debt On 28 July 2020 BMSL made three payments, totaling £33,005, to a company connected to BMSL. On 31 July 2020 BMSL made a further payment of £22,100 to a company, connected to BMSL, reducing BMSL’s bank account balance to £75.51. At liquidation BMSL owed £52,975.66 to its bank, £55,429 to trade creditors, and £58,952 to HM Revenue and Customs for VAT.
